Participant’s Release and Hold Harmless Agreement 

Notice: No person may participate in the Kids in the Game program without having signed and delivered the following Participant’s Release & Hold Harmless Agreement [herein referred to as the ‘Agreement’]; no minor may participate without the parent’s consent and signature.

I, the undersigned, hereby certify that I am the parent or legal guardian of the participant and grant permission for my child to attend the Kids in the Game program that I am registering for. I affirm that, to the best of my knowledge, the registration information provided is true and complete. I also feel that my child is physically capable of participating in strenuous activities.

In consideration of your accepting this agreement, I RELEASE – for myself and my heirs, executors, administrators, legal representatives, assigns, and successors in interest, and for my child [if parent or guardian signing on behalf of a participant under the age of 18, referred to as ‘my child’] – Kids in the Game and all other staff members, interns, organizers, and volunteers of this program, and the officers, directors, shareholders and/or members, agents and employees of each, as well as all medical, law enforcement and other personnel assisting with this program, the owners of property through which the program is held, and their representatives, successors and assigns [collectively ‘Released Parties’] from any and all rights, claims, or liability for damage for any and all injuries to my child, or my or their property arising out of or in connection with my participation in this program, including but not limited to CLAIMS ARISING FROM THE NEGLIGENCE OF THE RELEASED PARTIES and claims for damage caused by me, my child, or anyone else [including acts of God]. I PROMISE NOT TO SUE THE RELEASED PARTIES on behalf of me or my child regarding any claim arising from my and/or my child’s participation in the Kids in the Game. I further agree that I WILL DEFEND, INDEMNIFY, AND HOLD HARMLESS, the Released Parties against all claims, demands and causes of action, including court costs and reasonable attorneys’ fees, directly or indirectly arising from any action or other proceeding brought by or prosecuted contrary to this Agreement for the benefit of me or my child. This Agreement extends to all claims of every kind and nature whatsoever, whether known or unknown. I understand that the program and program activities are inherently dangerous activities, and I FULLY ASSUME THE RISKS ASSOCIATED WITH MY CHILD’S PARTICIPATION IN THIS PROGRAM, including but not limited to: the dangers of falls and collisions with other children, staff members, pedestrians, vehicles and fixed or moving objects; the dangers of all sports; the possibility of serious physical and/or mental trauma or injury or death associated with the program, sports participation, among others; and dangers caused by the NEGLIGENCE OF THE RELEASED PARTIES. I certify my child is physically and mentally fit to participate in this program. I understand that fees are necessary to meet the cost of preparations months in advance of the program, and that if the program is canceled because of weather conditions, fire, drought, acts of God, or other circumstances beyond the control of Kids in the Game, the fee will not be refunded. I understand that if my child is unable to participate in the Kids in the Game program due to sickness, unforeseen family circumstances, scheduling conflicts, or any other reason, my/our fee will not be refunded in any way. Deposits are non-refundable and non-transferable. By agreeing to this, I fully understand there are no refunds after registering.

I hereby authorize the staff of Kids in the Game to act for me according to their best judgment in any emergency requiring medical attention and I hereby waive and release Kids in the Game from any and all liability for any injuries, illnesses or lost property incurred while at the program. I have no knowledge of any physical impairment. I hereby authorize the designated physician to perform such diagnostic, medical and/or surgical treatment on my child as may be deemed medically necessary in order to assure the safety of my child. I will be financially responsible for any medical attention needed as a result of any injuries deemed by the staff of Kids in the Game. My agreement to sign (either physically or electronically) on this waiver also states that the above named child is covered by my personal medical insurance policy.

I am giving my permission to use photographs and videos of my child in programs in promotional materials for Kids in the Game. I hereby grant the Kids in the Game a perpetual, royalty-free license to reproduce, publish, circulate, or otherwise use any and all photographs and/or videotapes of me and/or my family taken at the Kids in the Game program, for any advertising, promotional, press, training and educational purposes.

Your electronic signature is the online equivalent of your ink-on-paper signature, and can be provided by signing your name where indicated. The electronic signature will signify your understanding, acceptance, and authorization to accept the conditions of this legal document, including the following statements:

I have read, have understood, and do accept the agreement above.

I understand that this is a legal document with effects that I approve and authorize.

The registrant is the person(s) whose name is submitted as the recipient of the goods and services provided as a result of this transaction.

I am authorized to agree to the terms of this document on behalf of the registrant.

If the registrant is under 18 years of age, incapacitated, or mentally challenged, I assert that I am the parent/legal guardian or otherwise authorized to execute a legally binding agreement on behalf of the registrant.

Kids in the Game Programming

Before sending your child to Kids in the Game programs, we want to make sure you understand that in light of the current medical, legal and economic conditions resulting from the Covid-19 pandemic, and recognizing that these conditions are subject to ever evolving change, you are sending your child to the program under the following conditions.

1. While we wish that we could control every possible risk, and while we will make every effort to keep your child safe from the COVID 19 virus and other communicable diseases, we want to make clear that we cannot promise or guarantee that this or any other pathogen will not enter the program, and that by the very nature of the personal interaction that takes place in the program environment, there is always a risk of your child becoming ill with this or any other communicable disease. We want you to be fully aware of this risk in making the decision to send your child to the program, and that you are willing to assume and accept it on your child’s behalf.

2. Our efforts to keep your child safe starts at home. We are asking more than ever for your partnership and honesty when dropping your child off each day. It is important that all health information shared be as accurate as possible, to the best of your knowledge, to help keep all participants, staff, and families safe. Keep your child home if they are exhibiting any symptoms of Covid-19 and communicate that with your program staff. Also alert administration if you or anyone in your household is exhibiting symptoms of Covid-19.

3. We believe in our ability to operate in a manner that meets our safety standards as well as those of the CDC, ACA, New York State, and New York City Departments of Health. Just as these guidelines have evolved over the past few months, they will continue to evolve. We will communicate any changes City, State, or Federal guidance has on Kids in the Game policies and procedures throughout the season.

As we know, COVID-19 will be with us for the foreseeable future. No matter what procedures and protocols are put in place, there is simply no way to guarantee that COVID-19 or any other pathogen or communicable disease will not enter the program. By the very nature of the personal interactions that take place in the program environment, there is always a risk of your child contracting this or any other disease or infection. And again, we will do everything within our power to keep your child healthy and safe.

I hereby acknowledge that I have read and understand the points as described herein.
